PF to manipulate 2020 census ahead of polls – Zambian Watchdog

PF Plans to rig 2021 by manipulating 2020 Census

After sensing an imminent defeat in 2021, the PF has embarked on many strategies to ensure that “victory” is sealed in 2021.

Census 2020 is one of the projects that has been identified to sustain the rigging strategy. The Central Statistical Office is being manipulated by the Permanent Secretary (PS) for Ministry of National Development Planning, Chola Chabala, aka CJ! CJ is married to a relative to Inonge Wina (we will discuss her UNZA degree later and her connection with UNZA Registrar) and is being used by the system as a conduit for corruption as well as the main manipulator for the 2020 Census Project. He is big headed fellow owing to this connection and thinks he knows it all and feels untouchable. Using his association with the Veep, he made sure that he elbowed everyone out of the PS position in this strategic ministry. More credible people like Dr. Buleti Nsemukila have to be shunted in far off places like Luapula and Eastern Provinces to keep them off from the Lusaka corridors of power. We are told that CJ hates Nsemukila with a lot of passion and those he perceives to be Nsemukila allies have been blacklisted, leaving him with some zombies who masquerade as professionals when they have nothing to show for their claim.
How is CJ manipulating the 2020 Census? In many ways but so far his strategy is to keep away experienced/qualified professionals from this PF Project. He started by surrendering one John Kalumbi who was Director of CSO between 2010 and 2017! Mr. Kalumbi, with other credible professionals, successfully executed the 2010 Census. Kalumbi was surrendered to Cabinet Office for querying the diversion of K4 million last year, which was meant for the census mapping exercise. CJ misled parliament last year, through Margaret Mwanakatwe, when she reported that mapping exercise for Census 2020 had commenced!
CJ has also appointed an IT person to be 2020 Census Manager! As much as we have respect for this manager, he is not the right person to be in that position because the task he has been given is not his area of specialization and we cannot experiment with census at this stage. A sister to Garry Nkombo (UPND MP for Mazabuka) who deputized Dr. Richard Banda (her hubby) in 2010 has been sidelined all because she is Tonga and related to this UPND bigwig. Her hubby has since been taken to Infrastructure Ministry to waste some time there as the crooks screw up the 2020 census. According to CJ, the UPND would have an upper hand if the sister to Garry led the census; but how is this possible this time around? Why didn’t UPND win the 2011 Elections having had this couple related to Garry manage the 2010 Census? Why is CJ keeping away professionals from the 2020 Census?
Last month he recommended the removal of the Acting Director alongside deputy directors in preference for new comers. The Director is to be replace by “God knows who” PF allied name from Bank of Zambia! Inside sources have revealed that CJ wants to use 2020 to divert resources to the ruling party or to himself (remember the “ubomba mwibala” slogan) as well as to inflate figures for the tribally perceived PF strongholds. This is in tandem with Lungu’s continued hallucinations about the Tonga-do not underestimate what Lungu has been saying. It is part of this grand scheme and the opposition must heed to this advice. Tribalism and violence are beneficial to Lungu/PF and they will ride on it as long as they remain in power.
Further, CJ has usurped the powers of the various Census Committees. We all know that 2000 and 2010 Censuses were well executed owing to the census committee system. For example, the Planning and Methodology Technical Committee, which is an integral committee of the census was in 2000 and 2010 led by credible UNZA Dons, Dr. Buleti Nsemukila and Dr. Namuunda Mutombo, respectively. How does the whole lot of a PS reduce himself to editing questionnaires and yet we have a lot of professionals who can lead this process? Is CJ going to analyze census data?
We are appealing to the opposition and all Zambians to watch out for the 2020 census manipulation, which has reached top gear. We also want to remind CJ and the PF government that the United Nations nullified the 1963 Nigeria Census because of malpractices such as what CJ and his tandem of crooks are planning to do. CJ, as former student of Demography knows this but we have a duty to remind him in case he has forgotten. A census must adhere to certain standards or else it will be nullified. The United Nations (UN) System is here in Zambia and they are watching all the census maneuvers of this brutal regime under the humble leadership of Edgar Chagwa Lungu. Remember there is also the UN Statistical Division in New York that is competent enough to detect problems in case the Zambian professionals are cowed into silence.
To the Secretary to Cabinet, Dr. Simon Miti; stop the rot going on at MNDP/CSO. As former PS at that ministry, you have the power to put this strategic ministry in order. You actually know, together with Dr. Auxilia Ponga, how toxic this Chabala is. Save the country from this disastrous trajectory. We are not campaigning for any individual here but we are merely appealing to you to restore order at CSO and the ministry at large. As long as you allow the manipulation that is going on, be assured that you will go down in the history books as that SC who failed to run Census 2020.

Minister Chitalu’s Partner in crime lives in fear of jail – Zambian Watchdog

Mulalelo Kakulubelwa, the Permanent Secretary at the ministry of health is living in fear of being arrested for various corrupt activities she has been made to undertake by minister Chitalu Chilufya.

Mulalelo Kakulubelwa (in photo) , who is known by many people only as Kaku is the official concubine of Minister Chitalu Chilufya. Together they have made a fortune from ministry of health tenders. Insiders say the two demand at least 10 % kickbacks from each tender or project under the ministry of health.

But now Kaku has started developing fear after realising that it’s her and other senior servants who actually sign these illegal deals and not the minister Chilufya. The minister only gives verbal orders and when the police come, he might get away with it but Kaku will certainly be jailed.

Minister Chilufya himself has been heard telling assistants that even if the ACC investigate him, his signature does not appear anywhere. But minister Chilifya is also just comforting himself. Senior ministry officials tell us that they are ready to testify when the time comes, as they have recorded audios and money trails to Minister Chilufya’ secret accounts some of which are held in the names of relatives and junior workers.
There are various corrupt activities that minister Chitalu and his PS girlfriend have undertaken but the issue of $11 Million worth of ambulances has left Kaku with Diarrhoea.

In 2015, the ministry of health, ZPPA and the security approved a tender to a local firm called Savenda to supply 50 Mercedes Benz ambulances. A commitment fee of 10 per cent was paid to Savenda and sample ambulances were brought into Zambia. Minister Chilufya in late 2018 told Parliament that this Savenda contract to supply 50 Mercedes Benz ambulances is irreversible.

But minister Chilufya and Kaku reversed this contract and replaced it with an illegal tender whereby they contracted Iveco South Africa to supply ambulances instead. Iveco has been paid and the cheap ambulances Iveco supplied were sneaked into the country though most of them have already broken down due to gear box problems.

Both health and finance ministry sources say Minister Chilufya and Kaku stole up to $5 million from this particular deal as the actual value of each Iveco ambulance is less than $30, 000.

The Anti-Corruption Commission and police frauds department have already concluded investigations in this case and have recommended the arrest of minister Chilufya and PS Kaku.

Government sources tell the Watchdog that Minister Chilufya has failed to explain what happened to the Savenda Benz ambulances and why people are seeing cheap Iveco wheelbarrows. According to people close to him, the minister gets emotional whenever this topic is brought up.

But instead of repenting, Minister Chilufya is accusing his Cabinet colleagues Tourism and Arts Minister Ronald Chitotela and his Home Affairs counterpart Stephen Kampyongo.

He now suspects that the duo have been feeding the Zambian Watchdog with damaging information about tenders under his charge but says the two Ministers are the biggest thieves in govt.

Minister Chilufya, it is feared among most high profile PF members has presidential ambitions and first attempt has been to position himself as President Lungu’s running mate in 2021 as a launch pad to the top.This has however unsettled entrenched crooks and “tenderprenuers” in PF circles.

“Dr. Chilufya has been branding the two Ministers in question as far much bigger thieves than himself and is determined to fight them because he has a booklet of a dossier on them. He has complained to the President about the campaign to destroy his name but as usual the Boss has done nothing. When Hon. Chitotela was facing abuse of office and corruption charges Dr. celebrated and this reached Hon. Chitotela. There is this assertion in govt that Dr. Chilufya’s kick backs actually exceed budgetary allocations for some ministries,” the source said recently.

The source said Minister Chilufya has been heard threatening that “tuka filila munsenga na ba makaka aba” in reference to Chitotela and Kampyongo who he insists are corrupt.

What appears to have upset the two Ministers is that Chilufya continues to front a squeaky clean personality and yet the opposite is true, his Cabinet colleagues have named him 10% or mobile ATM.
Minister Chilufya is said to be telling his close friends and colleagues that in serious govts Chitotela and Kampyongo would be serving time in jail for corruption and abuse of office.

HH educates Speaker Matibini on constitution – Zambian Watchdog

THE DOCTRINE OF EXCLUSIVE COGNIZANCE IS NOT CONSTITUTIONAL, HH TELLS SPEAKER

UPND President Hakainde Hichilema has told the speaker of Parliament Dr Patrick Matibini that his argument in his response to the letter written to him by Simeza Sangwa and Company on behalf of the Law Association of Zambia, that the National Assembly enjoys exclusive and unfettered jurisdiction in the conduct of its internal proceedings, is based on complete misunderstanding and is in disregard to the constitutional provisions and principles of the Constitution of Zambia.

In his letter to the Speaker dated 21st August 2019 and released to the press, Mr Hichilema stated that though the letter from the Speaker was directed to Simeza Sangwa and Company and was in public domain, he was compelled to reply to it on account of his right and obligation as a citizen of Zambia to defend the constitution of Zambia and promote its ideals and objectives.

“The letter from the Clerk raises two main points on which you based your refusal to suspend your legislative process in the National Assembly pending the determination of the matter in the Constitutional Court.

The two grounds stated in the letter are the doctrine of exclusive cognizance and selective application of the ‘sub judice’ rule to the proceedings of the National Assembly. In the letter, you argued that ‘the House (National Assembly) enjoys exclusive and unfettered jurisdiction in the conduct of its internal proceedings’ “, states Mr Hichilema.

He cites the second reason for the Speaker’s refusal to suspend the legislative process as his determination that the application of the ‘sub judice’ rule to the business of the House is not absolute and that it has to be decided by the Speaker on the merits of each case.

“You did not cite any constitutional provisions to support the above claims, save for the narrative followed when enacting legislation. As you have not cited any constitutional provisions that support your arguments, I have taken the liberty to search the Constitution of Zambia to assess the validity of your propositions. Your interpretation and purported application of the above principles is flawed on two grounds”, argues Mr Hichilema.

Mr Hichilema explains that that the doctrine of exclusive cognizance is not constitutional but only affords Parliament priveleges and immunity relating to its internal rules and operations provided they were exercised within the ambit of the constitution.

“It is the principle that applies to the United Kingdom, where because the country does not have a written constitution, Parliament is supreme. In Zambia however, the situation is completely different. All institutions including Parliament are creatures of the Constitution and amenable to it.
The law making function of Parliament is a constitutional and public function which cannot possibly fall within your narrow construction of what you term ‘internal proceedings’ of the House”, says Mr Hichilema.

Mr Hichilema alerts the Speaker to a dangers of usurping the constitutional power in his suggestion of the principle of sub judice not being absolute.

“Your claim that the sub judice rule is not absolute and depends on your discretion based on the merits of each case is grossly flawed as that would amount to your usurping a constitutional power, namely, judicial authority, which is lawfully allocated to the Judiciary in this case the Constitutional Court. Any other interpretation would be contrary to the Constitution and its values and principles expressed in the Constitution of Zambia”, stated Mr Hichilema.

Zambia signs 6 developmental contracts with India – Zambian Watchdog

President Edgar Lungu has thanked the Indian government for enhanced cooperation between Zambia and that country.

The President was speaking when he and Indian Prime Minister Narendra Modi witnessed the signing of six Memorandum of Understanding between Zambia and India.

Foreign Affairs Minister Joseph Malanji signed the MoU of Cooperation on Defence and Security, Art and Culture, Diplomacy and Health.

Electoral Commission of Zambia Chairman Justice Esau Chulu signed on Elections and Mines Minister Richard Musukwa signed on mining and Geology.

Mr. Modi said the MoU will further increase cooperation in mining, defence, cooperation in Airforce, Tele-education, Tele-medicine, and elections.

Mr. Modi further said India wants to invest in Healthcare, Agriculture, Food Processing and Mining among others.

Earlier, President Lungu said the Zambia-India Parliamentary Friendship Group bears further testimony of the excellent relations between the two countries.

The President was speaking in Hyderabad House Conference Hall during the bilateral talks with his Indian counterpart.

The President called for the revival of the meetings of the Zambia-India Joint Permanent Commission of Cooperation to ensure implementation of agreed areas of cooperation between the two countries.

On the standoff between Vedanta and Zambia Consolidated Copper Mines Investment Holdings, President Lungu said he met the Vedanta Chairman and that since the matter is in court, it would be best to let the rule of law to take its course.

The President was responding to Indian Prime Minister, Mr. Modi who hoped that the matter be resolved amicably.

The President expressed gratitude to India on hosting patients from Zambia who require specialized treatment and for training extended to Zambia in health.

The President thanked the Indian government for the generosity displayed in the financing and implementation of the Lusaka City Road Decongestion Project.

President Lungu yesterday morning visited the Indian President Ram Nath Kovind and was welcomed at the military parade of the Army, the Navy and Airforce by the President and Prime Minister Modi.

The President also visited the Raghad memorial site and laid a wreath on the grave of Mahatma Gandhi, India’s epitome of freedom.

And the President later in the afternoon addressed the Zambia-India Investment Business Forum attended by some of India’s business personalities.

The President assured the packed audience of the business community from both Zambia and India, of Zambia’s excellent business environment.

Meanwhile India has donated 1,000 tonnes of rice and 100 tonnes of milk to areas in Zambia where there is food deficit.

This is contained in a statement released to ZANIS in Lusaka by the President’s Special Assistant for Press and Public Relations Isaac Chipampe.

Sangwa explains supremacy of constitution to Matibini – Zambian Watchdog

Constitutional lawyer John Sangwa says the constitution of Zambia is superior to both the speaker of the National Assembly and the National Assembly itself.

Sangwa said this in a letter to speaker Patrick Matibini Who, with impunity, has set himself above the constitution and courts of law.

Sangwa has explained to Matibini that the Supremacy of the constitution clause is not a decoration but means that everything and everyone in Zambia is subject to the constitution.

Sangwa educated Matibini that the National Assembly and office of speaker are both creations of the constitution so they can not be above it.

Sangwa has warned Matibini that he might find himself in contempt of court if he continues disregarding court proceedings and orders.

BACKGROUND

Last week, the Law Association of Zambia filed an injunction in the Constitutional Court to restrain government through the National Assembly from enacting the Constitution (Amendment) Bill number 10 of 2019.

In view of the court process, LAZ lawyers Simeza Sangwa & Associates, wrote to National Assembly Speaker Matibini asking him to stop the process of enacting the Bill until the whole matter is determined by the Constitutional Court.

But Matibini informed LAZ that he won’t stop the proceedings because courts can’t interfere with parliament.

He claimed that parliament enjoys exclusive and unfettered jurisdiction in the conduct of its internal proceedings.
